An experienced trial lawyer, who the insurance company knows is prepared to go to trial, is more likely to be offered a fair settlement sooner by the insurer. There is a difference. Lawyers who charge a flat fee earn a percentage of your total recovery amount — usually 33-1/3%of the gross recovery before deducting litigation and other expenses. This percentage stays the same regardless of whether the case is decided by settlement, mediation, trial, or appeal. Lawyers who charge an increasing fee, however, can raise their percentage to as much as 45% if the case goes to trial, and as much as 50% if it’s won by appeal. At BLACKBURN 8 GREEN, we always charge a flat fee of 33-1/3% of the gross recovery before deducting litigation and other expenses, even if your case goes to trial or appeal. We’ll stand by you all the way to trial or appeal, if necessary, and remember, you don’t pay any attorney fee unless we make a recovery for you
